Abstract

Abstract

The research aims to demonstrate the importance of benefiting from solar energy, the legal ruling on the production of devices powered by solar energy, and the legal punishment due to those who attempt to seize these products, whether public or private, and highlights the leadership of the United Arab Emirates in leading the world in achieving the maximum possible benefit from it.The research approach is to follow the inductive and deductive approaches.The inductive approach is to explain the nature of solar energy, its types, its importance, models of its products, and the pioneering role of the UAE in solar investment.The deductive approach is to find out the Islamic ruling on the use of solar water, and the production of devices powered by solar energy, and to clarify the jurisprudential characterization and the legal punishment for those who seize public and private solar energy products, with a comparison between the jurisprudential schools.The research concludes that solar energy is a clean, renewable energy, and investment in it achieves environmental security and economic advancement, and that it is permissible to use solar water absolutely for purification and other purposes, and it is permissible to produce devices powered by solar energy, such as solar panels, heaters, air conditioners, and solar pumps, and the consequent reduction of the risks of conventional energy and greenhouse gas emissions.It also concludes that the penalty for those who seize public solar energy products is the punishment of what the ruler deems to be reprimanded, while whoever seizes private solar energy products, which are owned by individuals is a thief ,his punishment is the penalty for theft, as long as it is verified that he eavesdropped and removed these devices from their safeties.The research also highlights the pioneering role of the UAE in solar investment in taking the lead in its strategic initiative to achieve carbon neutrality by 2050, and its mega projects such as the Mohammed bin Rashid Al Maktoum Solar Energy Complex, the establishment of the Al Dhafra solar photovoltaic plant, the Shams 1 station, and the solar energy project. Concentrator (CSP), the Umm Al Nar station in Abu Dhabi, and other ongoing research projects.

The research recommends the need to develop community awareness of the benefits resulting from solar energy as a safe and clean alternative to traditional energy, and strive towards the advancement of societies by directing investment to solar energy to be environmentally friendly, and confront violators by trying to seize public and private solar energy products by enacting deterrent laws and imposing appropriate penalties, and supporting and encouraging research and studies that help develop solar energy research, holding conferences and seminars related to investment in it and the close relationship between it and environmental protection and economic development.
