Abstract

This study dealt with the types of penalties in Islamic Sharia and their degrees and the wisdom of their legitimacy from the indications of the texts of the Book and the Sunnah in jurisprudence and fundamental issues،  and the realization of the mandate in this and knowledge of the legal rulings and the deduction of scientific benefits that define the purposes of legislation and the wisdom of working with them. The study dealt with the meaning of the significance of the texts of the Book،  the Sunnah،  consensus and analogy،  in order to know the types of punishments in Islamic law،  their degrees،  the wisdom of their legitimacy and their specific and general significance. To prove this،  and in the conclusion the researcher mentioned some of the results such as: - The types of punishments in Islamic Sharia are many and different. - The degrees of penalties in Islamic law are graded from the lowest to the highest according to the crime and the interest،  and they fall with pardon and penance. - The wisdom of the legitimacy of punishments is great،  linked to private and public interests of the world and the hereafter،  then the researcher cited the sources and references.
